Company primarily stores the Personal Data we collect in the United States. If using a specific Elevar based Product or Service, Company may provide web pages or other mechanisms allowing you to delete, correct, or update some of the personal data, and potentially certain other information about you (e.g., account information). For instance, you can make changes to your account information by updating or modifying your online account information via the “Members” link in our settings menu. Company will make good faith efforts to make requested changes in Company’s then-active databases as soon as practicable, but it is not always possible to completely change, remove, or delete all of your information or public postings from Company’s databases and residual and/or cached data may remain archived thereafter. Further, we reserve the right to retain data (a) as required by applicable law; and (b) for so long as reasonably necessary to fulfill the purposes for which the data is retained except to the extent prohibited by applicable law.

Responding to Requests: Your request will be evaluated to determine whether the requested change meets legal regulatory requirements and does not risk making our other data less secure or changing our other data. If we cannot honor any part of your request, we will tell you that in our response, as well as the reason(s) we cannot do so.

Verifying Your Identity: Once the request has been received, you may be asked to provide additional personal data for verification purposes, including a copy of your state issued identification card before your request can be accommodated. For requests involving specific pieces of information, we may also require you to sign a declaration under penalty of perjury that you are the consumer whose personal data is the subject of the request.

Requests by Authorized Agents: If you are an authorized agent making a request on behalf of a consumer, we also require you to email consumerprivacy@buxtonco.com and do all of the following:

Provide us with valid written authorization, that the third-party agent has the authority to act on behalf of the individual whom they are making the request, which must include the agent’s name, email address, and phone number,
You must follow the instructions above to verify your own identity, and
The authorized agent must follow the instructions provided in this section to make a request.

As permitted by California privacy law, any request you submit to us is subject to an identification and verification process, and confirmation of the agent’s authority, which may include attestation under penalty of perjury. Absent the power of attorney, we will also require the consumer to verify their own identity. We may verify identity based on matching information you provided with data we have maintained on you in our systems. This data could include, but is not limited to, email address, mailing address, or phone number. We reserve the right to verify the validity of any third-party request to exercise privacy rights on behalf of our customers to the fullest extent permitted under applicable data protection law.

Appealing Our Decision: Depending on applicable law, you may have the right to appeal our decision to deny your request, if applicable. We will provide information about how to exercise that right in our response, denying the request.

If you live in the EU and the decision is not resolved, you may lodge a complaint with the supervisory authority about our processing of your data under this Privacy Notice. The appropriate supervisory authority is the data privacy regulator in which you live. If you live in the United Kingdom, it is the Information Commissioner’s Office, and you can report a concern at ico.org.uk/concerns.

C. Third Party Marketing and Your Additional California Privacy Rights

Separate from your “Do Not Sell” rights, California residents have the following additional rights regarding disclosure of your personal data to third parties for their own direct marketing purposes:

We provide California residents with the option to opt-in to sharing of “personal information” as defined by California’s “Shine the Light” law with third parties, other than with our affiliates, for such third parties’ own direct marketing purposes. As these rights and your privacy rights are not the same and exist under different laws, you must exercise your rights under this law and the other privacy laws separately.

D. Children’s Privacy

Our website is not aimed at or intended for children. Company does not knowingly collect, receive, disclose, sell, or share information from children under the age of 16. If we learn that we have inadvertently collected personal data relating to a child under the age of 16, we will delete that information from our records. If you believe we might have any information from or about a child under age 16, please let us know using the methods in the Contact Us section below.

HOW WE PROTECT YOUR PERSONAL DATA

We strive to take appropriate security measures to help safeguard your personal data from unauthorized access and disclosure. HOW LONG WE KEEP YOUR PERSONAL DATA

We will only keep your personal data for as long as it is necessary for the purposes set out in this Notice, unless a longer retention period is required or permitted by law (such as business records, tax, accounting, or other legal requirements). In determining data retention periods, we take into consideration the applicable law, contractual obligations, the purposes, the necessity, and your expectations. The retention period may therefore vary depending on the specific purpose and the specific country. For example, in some jurisdictions we are required to retain your billing information for at least 7 years due to accounting and tax obligations. CALIFORNIA CONSUMER PRIVACY ACT REQUESTS IN 2024

The table below details the number of requests we received from California residents under the California Consumer Privacy Act (CCPA) in 2024. A request is received when a consumer or their agent submits a request through our online form or contact center. A request may be denied if the consumer submitted a request but did not complete steps to enable us to verify their identity, or their identity could not otherwise be verified. A request submitted by an authorized agent may be denied if the agent did not provide sufficient documentation to allow us to determine that the agent was authorized by the consumer to submit the request.

Buxton takes the trust you place in us and the privacy of the information you share with us seriously. Buxton has implemented safeguards to avoid collecting precise geolocation data that could be deemed to be “consumer health data” under Washington, Nevada, and Virginia law and does not permit its customers to infer consumer health data from use of its products.
